Updated May 26th: The bills we have been following marked with a red line did not make the recent NCGA crossover deadline from the House to Senate or vice versa, and are therefore not advancing during this year’s legislative session. NCBPA recommends that member and industry professionals contact their legislators to support and oppose the remaining bills.

SUPPORT – SB358: Enable Commercial Property Assessed Capital Expenditures & Resilience (C-PACE) Program
This bill seeks to enable a Commercial Property Assessed Capital Expenditures & Resilience (C-PACE) program at the state level, which would then allow local governments to participate in available financing programs. NCBPA recommends that member and industry companies support this bill.
Current Status: Not subject to NCGA’s recent crossover deadline due to finance components in the bill, active in the state Senate.

SUPPORT – HB342: Require New Homes to be Wired for Electric Vehicles
HB342 was recently introduced and would amend the North Carolina Residential Building Code to require that new construction one- and two-family dwellings have an electrical circuit installed to accommodate electric vehicle charging. NCBPA supports this bill and recommends that member and industry companies contact their representatives in support of it.

SUPPORT – HB245: Extend Energy and Water Savings Goals in Public Buildings
HB245 was introduced in the 2021 session to extend the state’s existing Energy Savings Performance Contracting (ESPC) program and goals that help public buildings save energy and water through performance contracting. NCBPA has pushed for this legislation for many years, most recently with 2019’s HB330, and recommends that member and industry companies support it.
Current Status: Passed the House prior to the recent NCGA crossover deadline, currently in Senate Rules Committee for review.

OPPOSE – HB489: 2021 Building Code and Dev. Reg. Reform
HB489 was introduced by Rep. Brody and other sponsors as a regular annual update to the state’s building code requirements. Only one item of concern stands out to NCBPA, which would change current Cost-Benefit Analysis procedures to allow for any third-party entity to submit required cost-benefit analysis information on behalf of a code proponent. One major issue that has been challenging all parties in the code making process is the lack of policy and procedure on this very issue. The lack of clarity has led to at least two proposals that NCBPA has opposed being denied on account of a lack of cost-benefit justification. NCBPA opposes this measure as it will make it easier for organizations to propose bad and harmful code proposals without going through the effort to justify them on their own.

SUPPORT – SB509: An Energy Resilient NC
SB509 would create and fund a grant program through the State Energy Office that would improve the energy resilience, energy democracy and energy security of communities across the state. NCBPA supports this bill as it would create new opportunities for building performance, energy efficiency and clean energy in communities across North Carolina.

OPPOSE – HB529: Repeal Renewable Energy Portfolio Standard
HB529 would repeal North Carolina’s long-standing Renewable Energy and Energy Efficiency Portfolio Standard (REEEPS) which has been perhaps the largest market development tool to drive investment in clean energy in the state. This type of legislation is introduced most legislative sessions by parties that oppose continued investment in clean energy. NCBPA recommends that member companies oppose this legislation.

SUPPORT – HB638: State Clean Energy Goal for 2050
HB638 would create a statewide goal of 100% clean energy by 2050. NCBPA supports this bill as it would create a wealth of new opportunities and jobs for our industry.
